I’m a British citizen currently staying in Germany. I entered the Schengen Area through Luxembourg on 1 September and then travelled by coach to Germany. I’m in Germany for a British Council ELA role and need to apply for a German residence permit because I’ll be staying longer than the normal visa-free period. My sister is getting married in November, and I really don’t want to miss the wedding. My plan is to leave Germany on 31 October, travel through Luxembourg, attend the wedding from 1 to 7 November, and then return to Germany through Luxembourg on 8 November. Based on my calculations, I should still have around 23 days remaining under the Schengen 90/180-day visa-free allowance when I return. My concern is my residence permit application. If I apply for the German residence permit before leaving and the application is still pending when I travel, could leaving Germany affect my ability to re-enter? I’ve heard that once a residence permit application is pending, leaving Germany without the correct documentation can sometimes create problems when trying to return. Has anyone been in a similar situation as a British citizen? Would I still be able to re-enter through Luxembourg using my remaining visa-free Schengen days, or could my pending German residence permit application prevent me from returning? Any experience or guidance would be greatly appreciated. I really don’t want to miss my sister’s wedding.

I would not leave on a pending application alone if the wedding is that important. Safest sequence many people follow: 1. Book the Ausländerbehörde appointment / submit the ELA residence application as early as your documents allow. 2. Ask specifically for a Fiktionsbescheinigung with re-entry rights for your November travel dates. 3. Only fly/coach out once that paper is in your passport booklet or as the separate certificate they issue. 4. Keep copies of the application receipt. If they cannot issue travel-enabled Fiktion before 31 October, seriously consider postponing the filing until after 8 November - but only after a fresh 90/180 check and employer OK. Missing the wedding would be awful; getting refused re-entry and disrupting the British Council placement would be worse. Get the authority's answer in writing this week if you can.

Re-entering through Luxembourg does not bypass German residence rules. Luxembourg is still Schengen external/internal movement depending on your routing, but your long-stay intent is tied to Germany. If you present as visa-free short stay, officers can ask: - where you live - who employs you - how long you already spent in Schengen since 1 September - whether you already applied for a German residence title A pending German application without travel permission can look inconsistent with "just visiting for a wedding and returning as a tourist." Carry a clear paper trail either way: wedding invitation, return ticket, British Council letter, proof of address in Germany, and - if issued - the Fiktionsbescheinigung. Still, written confirmation from the Ausländerbehörde beats any border improvisation.

Practical options people in Germany usually weigh for a short family trip during a pending permit: A) Apply now, wait for a Fiktionsbescheinigung that allows exit/re-entry, then travel with passport + Fiktion + appointment proof + British Council employment letter. B) Delay filing the residence permit until after you return from the wedding, if your remaining visa-free days truly cover both the trip and the time until you can lodge the application. Only do this if the 90/180 math is solid and your employer accepts the timing. C) Travel only after the residence card (or at least a clear travel-enabled Fiktion) is in hand. For a sister's wedding, option A is often the cleanest if the authority will issue the right Fiktion quickly. Option B avoids a pending-file problem but only works if you are still fully inside short-stay rules. Ask the office which option they recommend for a British Council ELA - they see this pattern often.

On the 90/180 calculation: double-check it carefully. Entering via Luxembourg on 1 September still counts as Schengen presence for the whole time you stay in Germany afterward. Coach travel inside Schengen does not "reset" the clock. If you leave 31 October and return 8 November, those November days also count toward the same 90/180 window. Border police can recalculate on the spot. If your remaining short-stay balance is wrong by even a few days, re-entry as a visa-exempt visitor can be refused. Also: returning "as a tourist / visa-free visitor" while you clearly intend to continue living and working in Germany for the British Council role can raise questions at the border about purpose of stay. That is separate from whether the mathematics of 90/180 looks okay on paper.

As a British citizen you are a third-country national for Schengen purposes, so the residence-permit question matters a lot. If you file the Aufenthaltstitel application and then leave Germany while it is only "pending," many Ausländerbehörde offices treat re-entry as risky unless you have a Fiktionsbescheinigung that expressly allows travel and return (check the boxes on the certificate - not every Fiktion allows leaving Germany). Without the right travel/re-entry annotation, people sometimes: 1. get stuck outside and cannot continue the application as planned, or 2. are told the application is considered withdrawn after departure. Before you book irreversible tickets, email or visit your local Ausländerbehörde with your exact dates and ask in writing whether you may leave for the wedding and re-enter. Do not rely only on forum math.
